SITE USAGE AGREEMENT
The following terms of use apply to any visitor or user (hereinafter referred to as "User" or "you") of the website www.hawkerbeechcraft.com and any websites that are hyperlinked to and from the website www.hawkerbeechcraft.com (hereinafter singularly and collectively referred to as "the Site") that Hawker Beechcraft Corporation or its subsidiaries and affiliates (hereinafter singularly and collectively referred to as "Hawker Beechcraft" or “we”) own and control, and to the products, services, resources, information, data, specifications, photographs, text, audio, video and other content displayed on the Site ("Material"). By using the Site, User acknowledges acceptance and agreement with the terms and conditions of use herein. If User does not agree with these terms and conditions, User must discontinue use of the Site immediately. Note that the use of certain Material or the conduct of certain transactions on the Site may be subject to additional terms and conditions that will be made available to User prior to using such Material or completing such transactions. Hawker Beechcraft may at any time or from time to time change the Site Usage Agreement. By using the Site, User agrees to be bound by any such changes.
1. General Conduct & Limited License
1.1 User may access, display, and print one copy of the Material solely for User’s personal, internal, non-commercial use (“Use”), except as otherwise provided on the Site. No other use of the Material is authorized. User agrees that the copy of the Material shall retain all copyright, trademark and other notices in the same form and in the same manner as such notices appear on the Material or on the Site. User may not otherwise reproduce, modify, distribute, transmit, post, or publish the Material without Hawker Beechcraft’s prior written consent.
1.2 User understands and agrees that any Use of the Material is at User’s own discretion and risk. User will be solely responsible for any damage to User’s network, software or computer system, or any loss of data that results from the Use of the Site or the Material.
1.3 While visiting the Site, User shall not submit, post, publish, distribute or transmit: (a) material that is illegal, indecent, obscene, libelous, defamatory, false or misleading; (b) material other than that which may be requested by an interactive application or tool on the Site; (c) unsolicited advertising, promotional material, or other forms of solicitation; (d) material that would infringe the intellectual property, privacy or other rights of third parties, (e) a computer virus, worm, Trojan horse or other element destructive to the Site or any Hawker Beechcraft hardware or software accessible through the Site, or (f) a digital or manual signature, password, or other element impersonating a Hawker Beechcraft employee, or any forged TCP/IP headers or parts of a header, in an attempt to gain unauthorized access to Hawker Beechcraft's computers, software, data, accounts or databases.
1.4 User may not, without the prior written consent of Hawker Beechcraft, use any computer code, data mining software, “robot,” “bot,” “spider,” “scraper” or other automatic device, or program, algorithm or methodology having similar processes or functionality, or any manual process, to monitor or copy any of the web pages, data or content found on this site or accessed through the Site. User also may not engage in the mass downloading of files from the Site; use the computer processing power of the Site for purposes other than those permitted above; or flood the Site with electronic traffic designed to slow or stop its operation.
2. Third Party Material
2.1 The Site may include Material owned by third parties, as well as links to websites owned by third parties (singularly and collectively “Third Party Material”). Access to and use of any Third Party Material is at the User's own risk and Hawker Beechcraft is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made in such Third Party Material.
2.2 Hawker Beechcraft’s inclusion of Third Party Material on the Site shall not be construed as Hawker Beechcraft’s endorsement of any third party or the Third Party Material, and no rights or licenses are granted to User in the Third Party Material. User agrees to defend and hold Hawker Beechcraft harmless from any liability that may result from User’s use of the Third Party Material.
3. Intellectual Property
3.1 The Site and the Materials comprise Hawker Beechcraft and third party intellectual property, and are protected by United States and International laws. Except as otherwise provided herein, nothing contained herein shall be construed as granting any license or right to User under any patent, trademark, copyright or other intellectual property right of Hawker Beechcraft or any third party.
3.2 "Hawker" and “Beechcraft” are registered trademarks of Hawker Beechcraft. Any trademarks, trade names, trade dress, service marks, logos, domain names, and URLs ("Marks") provided in the Material or displayed on the Site are the property of Hawker Beechcraft or third parties, and no right to use such Marks is granted to User herein.

4. Accuracy and Timeliness of Information and Historical Information
Hawker Beechcraft assumes no responsibility to monitor the accuracy, completeness, timeliness or reliability of any Material on this Site. As such, Material may not be updated when errors are uncovered or as new information becomes available. User understands that certain Material, including, but not limited to, annual reports, press releases, and product information, may become stale or incomplete over time, and releases Hawker Beechcraft from any and all liability associated with same.
Hawker Beechcraft original content which may be archived on Hawker Beechcraft-provided sites is believed to be accurate at the time of creation and original date of posting. However, it should be understood by User that the passage of time, subsequent events and other changes may make the posting stale.
Although such content may be included on such sites as archival material, Hawker Beechcraft may not have updated, edited, changed or removed the content, and disclaims any obligation to do so. To the extent reliance on dated material is made, it is done so at User's risk.
5. Submissions to the Site
Any information, feedback, links, or other material User submits to the Site (“Submissions”), will be considered non-confidential and User grants Hawker Beechcraft a non-exclusive, perpetual, worldwide, royalty-free license to use the Submissions in any way it chooses, subject to any limitations set forth in Article 10, “Privacy Policy”. Therefore, Hawker Beechcraft may, among other things, reproduce, transmit, distribute, adapt, perform, display and create derivative works from User’s Submissions, and sublicense others to do any of the foregoing activities. User agrees that its Submissions will meet all requirements for appropriate content in accordance with Section 1.3 above. Hawker Beechcraft reserves the right at any time and without notice, to refuse to receive, post or remove any Submission.
6. Compliance with Applicable Laws; Export Control Laws
The Site and the Material may be subject to U.S. export control laws and may also be subject to the laws of the country where you reside. User agrees to comply with all applicable laws, statutes, ordinances, and regulations regarding User’s use of the Site. Hawker Beechcraft makes no representation that the Site or the Material is appropriate or available for use in other jurisdictions. If User chooses to access this site from such a jurisdiction, User does so at its own risk. The laws of the State of Kansas, United States of America, excluding choice of law principles, will govern and construe all issues relating to use of the Site and the Materials.
7. Disclaimers
7.1 UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL OR EQUITABLE THEORY SHALL HAWKER BEECHCRAFT, ITS OFFICERS, EMPLOYEES, DIRECTORS, AGENTS, SUPPLIERS, OR ANY OTHER PARTY INVOLVED IN PROVIDING THE SITE, BE LIABLE TO USER OR ANY OTHER PERSON FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR REVENUES, COSTS OF REPLACEMENT GOODS, LOSS OR DAMAGE TO DATA, SOFTWARE OR HARDWARE ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE SITE, THE MATERIAL, ANY Hawker Beechcraft PRODUCT OR SERVICE, OR ANY OTHER HYPERLINKED WEBSITE, OR ANY DAMAGES RESULTING FROM THE USE OF OR RELIANCE ON THE MATERIAL PRESENTED, EVEN IF Hawker Beechcraft HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7.2 ALL MATERIAL PROVIDED ON THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. Hawker Beechcraft DISCLAIMS ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THOSE ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. THE INTERNATIONAL CONVENTION FOR THE SALE OF GOODS, THE UNIFORM COMPUTER INFORMATION TRANSACTIONS ACT AND THE UNIFORM ELECTRONIC TRANSACTIONS ACT ARE EXPRESSLY DISCLAIMED.
8. Indemnity
USER AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS Hawker Beechcraft, ITS OFFICERS, EMPLOYEES, DIRECTORS, AGENTS, SUPPLIERS, OR ANY OTHER PARTY INVOLVED IN PROVIDING THE SITE, FROM AND AGAINST ANY AND ALL CLAIMS, SUITS, DAMAGES, COSTS, OR OTHER EXPENSES (INCLUDING REASONABLE ATTORNEYS FEES) THAT ARISE DIRECTLY OR INDIRECTLY FROM: (A) USE OF THE SITE OR THE MATERIAL, (B) BREACH OF THESE TERMS OF USE; AND/OR (C) USER'S SUBMISSIONS TO THE SITE.
9. Privacy Policy
9.1 Personally Identifiable Information Collected
To respond to User’s requests or to enable User to register on the Site, we may request such personally identifiable information as User’s name, residential or business address, email address and/or telephone number. If User is ordering products or services, additional personally identifiable information may be requested. However, User does not need to provide us with personally identifiable information to use many of the features of the Site. The personally identifiable information will not be given out to third parties not affiliated with Hawker Beechcraft. To the extent that User provides personally identifiable information to sites that link to or from the Site, User understands that different rules may apply to the use and disclosure of such personally identifiable information. To the extent that the Site includes third-party advertisements, User understands that the privacy policy of the advertiser providing the advertisement governs the use of any personally identifiable information collected during User’s access of the advertisement.
9.2 Types of Information Collected
A. IP Addresses
An internet protocol address is automatically assigned to User’s computer when User accesses the internet, and is used by web servers to identify User’s computer. When visitors access our Site, we may log the IP address, however, the visitor’s identity remains anonymous to us. We log the address for system administration and for auditing the use of the Site. We may also use the IP addresses to collect statistical information for marketing and other purposes.
B. Cookies
From time to time, we may place information on User’s computer to allow us to identify you. This information is known as a “cookie”. We will only use cookies to view information on User’s computer’s hard drive that was placed there by a cookie from our Site. However, a cookie will not allow our Site to learn any personally identifiable information that User has not otherwise disclosed (except as otherwise provided in Section 10.3B below). By understanding how and when our visitors use the Site, we can continually improve our Site, as well as our products and services. The use of cookies is an industry standard, and many websites use them. If you wish to disable cookies, browser permitting, User’s browser can be reset to refuse all cookies or indicate when a cookie is being sent.
C. Web beacons
Web beacons are small files that we may place on the Site, which count the number of unique users that have visited a specific page on the Site and the number of times the page has been displayed. This information is collected only in the aggregate and is generally not linked to any personally identifiable information (except as may otherwise be provided for in Section 10.3B below).
9.3 Information Use
A. Use and Sharing of Information
Hawker Beechcraft and its affiliates may use any personally identifiable information you provide, unless otherwise indicated, and we will not provide your personally identifiable information to any other entity unless authorized by you. Anonymous data collected using cookies and web beacons may be analyzed in the aggregate to determine collective user characteristics, to understand user traffic patterns, sales information and user behavior on the Site. Such information also may be shared in the aggregate with third parties for advertising purposes, to enhance our Site, to enhance our products and services, and to analyze how and where best to use our resources.
B. Monitoring
Although Hawker Beechcraft is under no obligation to monitor the Site, we may monitor, store, review and disclose to third parties any information obtained on the Site as may be needed or requested to satisfy any applicable governmental law, regulation or proceeding. Additionally, we may use IP addresses to identify a particular user if we believe it needed to enforce compliance with these terms or to protect our Company, Site, or customers.
9.4 Security of Personally Identifiable Information
While Hawker Beechcraft tries to prevent third party, non-affiliate access to personally identifiable information, User understands that internet communications may not be secure. In view of the foregoing, Hawker Beechcraft cannot warrant that User’s personally identifiable information will not be disclosed to or accessed by parties other than those authorized under these terms and conditions. User agrees that Hawker Beechcraft will not be liable for such disclosures of User’s personally identifiable information.
9.5 Updates to Your Information
At User’s request, Hawker Beechcraft will make reasonable efforts to update, change or delete any personally identifiable information User may have earlier provided via the Site. User understands that to enforce these terms, resolve disputes, or provide information to satisfy applicable governmental laws, regulations or proceedings, Hawker Beechcraft may need to retain User’s personally identifiable information in its files. Additionally, User understands that User’s personally identifiable information may be retained in residual back-up files that are a function of our network’s back-up systems.
9.6 Privacy of Children
The Site is not to be used by anyone under the age of eighteen (18), and any child under such age should not provide personally identifiable information. Hawker Beechcraft will not knowingly collect or use personally identifiable information from any child under such age.
10. Termination and Survival
10.1 This Agreement shall expire when the User discontinues use of the Site.
10.2 Hawker Beechcraft reserves the right to change or modify these terms, or terminate this Agreement at any time. In the event of breach of these terms, Hawker Beechcraft may terminate User’s current and future use of the Site and the Materials.
10.3 Sections 1, 2, 3, and 5 through 10 shall survive any termination or expiration of this Agreement.
RAPID
The following terms and conditions shall govern purchases of spare parts, ground support equipment, services of repair and overhaul, repair kits, reports, data, specifications, etc. for the Aircraft (collectively, “Aircraft Support Items”) from Rapid Aircraft Parts Inventory and Distribution Company, LLC, (“RAPID”) a Kansas Limited Liability Company, and shall be incorporated into any Purchase Order(s) issued to RAPID by CUSTOMER for Aircraft Support Items. The placement of an order by CUSTOMER shall constitute acceptance by CUSTOMER of these terms and conditions. Any terms or conditions proposed by CUSTOMER inconsistent with or in addition to these terms and conditions shall be void and of no effect, unless specifically agreed to by RAPID.
TAXES. The prices set forth in individual Purchase Orders issued by CUSTOMER for Aircraft Support Items shall include all federal, state and local taxes imposed by the United States Government, any U.S. state or local government, or any agency, authority or department thereof. Such prices do not include any taxes, import duties or similar fees which may be levied or imposed upon the Aircraft Support Items or this Agreement or transaction by any other country, state, local or equivalent government, or any agency, authority or department thereof. Any such taxes, import duties or similar fees levied or imposed by any other government or any agency or department thereof shall be the sole responsibility of CUSTOMER. Therefore, any such taxes, import duties or similar fees will be added to the price of the Aircraft Support Items unless CUSTOMER provides RAPID with an appropriate exemption certificate. CUSTOMER agrees to indemnify and hold RAPID harmless from and against the payment or imposition of any such taxes, import duties or similar fees.
DELIVERY. Delivery terms shall be EX Works, RAPID’s warehouse. Partial and immediate delivery of Aircraft Support Items shall be permitted at RAPID’s sole discretion. Title and risk of loss with respect to Aircraft Support Items shall pass to CUSTOMER upon delivery at RAPID’s warehouse, of said Aircraft Support Items to CUSTOMER or upon delivery to the shipping carrier. When an order is for two or more items RAPID may, at its discretion, ship either in lots or in a single shipment.
DELIVERY DELAYS. Delivery and shipping dates are estimates. Under no circumstances will RAPID be liable for any delay or failure in the delivery of Aircraft Support Items, or for any damages suffered by CUSTOMER by reason of such delay or failure, when the delay or failure is directly or indirectly caused by or in any manner arises from acts of God; acts of public enemies, the elements; fires; floods; accidents; riots; wars; actions or inactions of government; acts of terrorism; labor difficulties; inability to secure, delay in securing or shortages of raw materials, labor, fuel, power or transportation, delay or failure of any supplier; breakdown or destruction of plant or equipment arising from any cause whatsoever; or any other cause or causes (whether or not similar in nature to any of those specified) beyond RAPID’s reasonable control. In no event will RAPID be liable for any consequential damages, incidental damages, damages for loss of use or damages for loss of profits for any delay or failure in delivery regardless of the reason.
PRICES AND PAYMENT. Prices are subject to change without notice. All orders are accepted subject to RAPID’s price in effect at time of shipment. Payment is due immediately upon receipt of proforma billing or by due date shown on the RAPID invoice. In no event shall CUSTOMER set off any payment due with any claim RAPID owes CUSTOMER, whether related to this purchase or any other transaction. CUSTOMER’s payments shall be made by either check or interbank wire transfer directly to RAPID's bank account, as shown of the proforma billing or the RAPID invoice. If any payment due to RAPID from CUSTOMER is delayed by more than sixty (60) calendar days beyond the date of invoice, then the balance due is subject to interest at a rate 1.25 times the monthly prime interest rate charged by Bank of America of New York, New York, during the period of time such payments remain unpaid. CUSTOMER grants, with respect to the Aircraft Support Items delivered to CUSTOMER, a purchase money security interest and in all accession and proceeds thereof. This purchase money security interest shall be effective until CUSTOMER has made payment in full.
CHANGES. RAPID shall have the right, without the consent of CUSTOMER, to make changes in the Aircraft Support Items and to substitute equivalent equipment, accessories or material where such changes or substitutions are deemed necessary by RAPID; provided that such changes or substitutions shall not adversely affect the price, time of delivery or performance of the Aircraft Support Items, nor significantly affect its design, performance, weight or balance; and provided further that, in the event such changes or substitutions are for any reason not accepted by CUSTOMER shall be permitted to return the changed or substitution equipment, accessories or material to RAPID and receive a full credit against its purchase of them provided that the changed or substitution equipment, accessories or material has not been installed on any aircraft, in which event any right of repair or return shall be governed by the RAPID Limited Warranty described below. RAPID will advise CUSTOMER of any changes to Aircraft Support Items ordered by CUSTOMER and will provide the reasons for such change. RAPID will notify CUSTOMER of any such changes and the reasons therefor as soon as reasonably possible and will endeavor to do so prior to delivery of the items to CUSTOMER. RAPID’s notice to CUSOMER may be provided by U.S. mail, telefacsimile, telephone or by e-mail.
PAPERWORK PROVIDED. RAPID does not supply manufacturer’s certifications for Aircraft Support Items. Lot or batch numbers are not provided unless the Aircraft Support Item is a color or serialized part.
ENTIRE AGREEMENT. These terms and conditions and the purchase order to which they are attached represent the entire agreement between RAPID and CUSTOMER with respect to this subject matter and supersedes all prior oral and written understandings and agreements of the parties.
AMENDMENTS. Any extensions, amendments, modifications or supplements to these terms and conditions and/or the purchase order to which they are attached must be accomplished in writing by RAPID and CUSTOMER.
CONFIDENTIALITY. These terms and conditions and the purchase order to which they are attached are strictly confidential between RAPID and CUSTOMER. Except as may be required by law, each party shall use its reasonable commercial efforts to keep these terms and conditions and the purchase order to which they are attached confidential; provided, each party may disclose, without the prior written consent of the other party, to such party’s employees, officers, directors, accountants, lawyers, bankers, investors, insurers, shareholders, financiers, agents and consultants.
DAMAGES. RAPID SHALL NOT BE LIABLE FOR ANY GENERAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY DAMAGES FOR LOSS OF USE, LOSS OF PROFITS OR DIMINUTION OF MARKET VALUE, AND RAPID SHALL NOT BE LIABLE FOR ANY DAMAGES CLAIMED BY THE CUSTOMER OR ANY OTHER PERSON OR ENTITY UPON THE THEORIES OF NEGLIGENCE OR STRICT LIABILITY IN TORT AS A RESULT OF RAPID’S PERFORMANCE UNDER THESE TERMS AND CONDITIONS AND THE PURCHASE ORDER TO WHICH THEY ARE ATTACHED.
GOVERNING LAW. The laws of the state of Kansas as effective and in force on the date of the Purchase Order to which these terms and conditions are attached shall apply to the sale of the Aircraft Support Items by RAPID to CUSTOMER.
EXPORT. Any subsequent export or re-export of the Aircraft Support Items shall be accomplished in accordance with all applicable U.S. export laws and regulations, including the International Traffic in Arms Regulations or Export Administration Regulations. In connection with and without limiting the general applicability of the foregoing, CUSTOMER shall not export or re-export the Aircraft Support Items to nationals of prohibited countries or to any non-U.S. Persons (as defined in Section 120.16 of the International Traffic in Arms Regulations) whether in the United States or abroad unless the necessary export licenses have been obtained. In the event CUSTOMER exports the Aircraft Support Items from the United States, RAPID will not be designated the exporter of record. CUSTOMER indemnifies RAPID from and against the consequences of any failure of CUSTOMER to comply with the above stated U.S. export laws and regulations. Diversion of the Aircraft Support Items contrary to U.S. law is strictly prohibited.
RAPID Part Limited Warranty Effective 2007, and after
All RAPID parts covered by the following LIMITED WARRANTY, which gives Buyer specific legal rights.
The law of Kansas applies to this warranty.
A. RAPID AIRCRAFT PARTS INVENTORY AND DISTRIBUTION (RAPID) LIMITED WARRANTY
(1) Subject to the limitations and conditions hereinafter set forth, RAPID warrants, at the time of delivery by RAPID, each part to be free from (i) defects in material or
workmanship and (ii) defects in design that in view of the state of the art as of the date of manufacture should have been foreseen; provided, however, that the defect must
be discovered within twelve (12) months for New, Overhauled and Rebuilt parts and three (3) months for Repaired and Serviceable parts from the date of installation of the
part; or twenty-four (24) months for New, Overhauled and Rebuilt parts and six (6) months for Repaired and Serviceable parts from Shipment from RAPID, whichever time
period first expires or event first occurs. The claim should be filed within 60 days of discovery of the defect.
(2) The entire extent of RAPID'S liability shall be limited to that of either reimbursing Buyer for its costs of purchasing a Rebuilt, Overhauled, Repaired or Serviceable part
from either RAPID or a properly Rated Hawker Beechcraft Authorized Service Center or, at RAPID’S election, reimbursing Buyer for its costs of having the part repaired at a
properly Rated Hawker Beechcraft Authorized Service Center. If RAPID elects not to repair the part and if neither a Rebuilt, Overhauled, Repaired or Serviceable part is, in
RAPID'S opinion, timely available then RAPID will reimburse Buyer for its costs of purchasing a new part from RAPID. The labor necessary to remove from the Airplane
such part and to reinstall in the Airplane such part, shall be covered by this Limited Warranty, provided the work is performed at a properly Rated Hawker Beechcraft
Authorized Service Center. The part to be replaced must in all instances be returned, shipping prepaid, to Hawker Beechcraft RAPID'S LIMITED WARRANTY will apply to
any part repaired or replaced by a properly Rated Hawker Beechcraft Authorized Service Center pursuant to RAPID'S LIMITED WARRANTY: however, the applicable
warranty for such part repaired or replaced shall be limited to the unexpired portion of RAPID'S LIMITED WARRANTY described in paragraph (1) above, as applicable. In
other words, the warranty period of the part repaired or replaced does not start over from the date of reinstallation.
B. LIMITATIONS APPLICABLE TO RAPID’S LIMITED WARRANTY
(1) RAPID will be relieved of all obligations and liability under this Warranty if:
- The alleged defect in the part is due to misuse or negligence on the part of someone other than RAPID; or
- RAPID identification mark or name or serial number has been removed from the part in question; or
- The Airplane and/or equipment have not been maintained, operated or stored either in accordance with applicable manuals, communications or other
written instructions of Hawker Beechcraft or any manufacturer of the part involved, or in accordance with applicable Federal Aviation Regulations and
advisory circulars unless Buyer shows that such maintenance, operation or storage was not a contributory cause of the defect; or
- The part has been modified or altered after delivery other than by the Manufacturer or in accordance with a modification or alteration scheme approved in
writing by the Manufacturer; or
- The part is used on the Airplane for purposes other than conventional owner/operator usage and exceeds 1000 total part hours. Usage not considered
owner/operator includes, but is not limited to, scheduled airline, shared ownership fleet, government/military or special mission operations.
(2) For the purpose of this Limited Warranty, no part or equipment will be regarded as defective merely because, subsequent to its delivery, some modification or
alteration becomes necessary for product improvements or in order to meet a change in the requirements of any applicable Federal Aviation Regulation.
(3) BUYER WAIVES AS TO SELLER AND RAPID ALL OTHER WARRANTIES, WHETHER OF MERCHANTABILITY, FITNESS OR OTHERWISE. THERE ARE NO
WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF.
(4) THE OBLIGATIONS OF RAPID SET FORTH HEREIN SHALL BE THE EXCLUSIVE REMEDIES FOR ANY BREACH OF WARRANTY HERE-UNDER, AND, TO
THE SAME EXTENT, NEITHER RAPID NOR SELLER SHALL BE LIABLE FOR ANY GENERAL, CONSEQUENTIAL OF INCIDENTAL, DAMAGES, INCLUDING,
WITHOUT LIMITATION, ANY DAMAGES FOR DIMINUTION OF MARKET VALUE, LOSS OF USE OR LOSS OF PROFITS, OR ANY DAMAGES TO THE AIRPLANE
CLAIMED BY THE BUYER OR ANY OTHER PERSON OR ENTITY UPON THE THEORIES OF NEGLIGENCE OR STRICT LIABILITY IN TORT.
(5) ANY ACTION BY BUYER FOR BREACH OF THIS WARRANTY BY EITHER RAPID OR THE PART SELLER MUST BE COMMENCED WITHIN ONE (1) YEAR
AFTER THE CAUSE OF ACTION ACCRUES. WITH RESPECT TO ANY DEFECT FIRST DISCOVERED ON OR AFTER JANUARY 1, 2006, THE CAUSE OF ACTION
ACCRUES WHEN THE BUYER FIRST LEARNS THAT THE WARRANTY HAS BEEN BREACHED.
CORE RETURN REQUIREMENTS
In order for us to supply our next customer with an exchange item of equal quality with the documentation acceptable to the regulatory authorities, we would appreciate your
attention to the following core return requirements.
- A copy of a RAPID document is required and should be attached when the core is returned. This could be a copy of the packing sheet or invoice on which the
part was purchased.
- Cores should be carefully repackaged to preclude shipping damage. Reuse the original packing material/methods supplied where possible.
- Cores must be returned with service data documented by a licensed mechanic or authorized repair station. Use the Parts Information Tag (Form No. 852-31487)
supplied herewith for the purpose. Parts Information Tag must be filled out completely.
- Installing agencies and repair station certification holders may identify return cores with their own approved repairable parts tag in lieu of Form No. 852-31487
provided that the same information is supplied.
RAPID reserves the right to return cores at customer expense and not issue core credit for cores that are BER (Beyond Economic Repair), incomplete data
tags, disassembled, not like for like part number or if the core returned exceeds normal run out condition and is going to incur charges over and above the
standard overhaul. Cores must be returned to RAPID within 30 days for Domestic orders / 45 days for International orders from the date of shipment. Address
labels are available through RAPID.
Failure to comply with the above requirements may delay or forfeit core credit issuance.

NEW PART RETURN REQUIREMENTS
For your benefit we have enclosed our return policy. If it becomes necessary for you to return a component purchased from RAPID, we will be able to respond to your claim
more efficiently if you follow these guidelines.
- Requests to return components must be made within 30 days from date of shipment.
- Reports of shortage in shipment must be made within 10 days from Invoice Date.
- Normal Handling Charges are 15% ($50.00 minimum/$500.00 maximum) on stock items. Rectification charges may also be applied to the return of specific parts.
All costs will be credited including freight, in the case of a RAPID error.
- All returns must have prior approval to return* and should be returned with all freight and custom charges prepaid. Items with prior approval will be processed in
a more timely manner.
- Original documentation, which includes all CAA/FAA Airworthiness Documentation furnished with the original shipment, must accompany the part.
- Please reuse the original packing material/methods where possible.
- Literature items are not acceptable for return.
- Claims to the carrier should be submitted upon receipt for obvious shortage or carton damage. If it becomes necessary to submit your claim to RAPID, a copy of
your claim and/or correspondence with the carrier must also be submitted. Statically sealed items must be returned unopened.
